Recently I was called to be an expert in a funeral home case in which the funeral home was the defendant and, as such, was required to defend their position surrounding alleged mis-treatment with a cremation service. Central to this case was the fact that a person who presented as the responsible party with decision-making authority was fraudulent, however, the truth did not come out until those who were legitimate came forward. To their credit, the funeral home stepped back and refused to go further with the service until the courts could rule on who had actual authority.
